I'm not sure what the current status of the bill is (that article is 
from March 2002) but it is true.

Maybe you should join the Texas Opensource Initiative mailing list (from 
  previous post today) so that we can try to make some better laws for 
Texas than they are making for the nation.  (We still have to abide by 
federal laws of course)
