I'd argue that restocking fee with them. If the computer won't run the
operating system of my choice -- its worthless to me and not what I paid
for. Try that argument and see if you can get all your money back. You
also might drop a hint of how much bad publicity Best Buy (in general and
that store in particular) is going to get in the Linux community when they
find out what Best Buy did/didn't do about a Linux problem!
As for recommendations, there are a number of companies that sell pre-loaded
Linux laptops. If you want to be absolutely sure that a laptop will work
with Linux -- that's probably the safest way to go. They might cost a
little more, but at least you're sure it works.

unfortunately bestbuy doesnt carry dells. only toshiba, sony hp and compaq.
i could return the one i have now (within thirteen more days) but id loose
15% of the price (a HUGE chunk of change) as a "restocking fee." :(
